If the Act were to be so read, the scope of the Act would become unclear and inconsistent with the legislative intent of the Act. 44 I find no ambiguity in the language of the Act. I believe that under the Act the government's duty to accept bids is limited to the role of procuring. That role is limited to receiving a formal offer from a bidder to supply goods and/or services. The duty of the government to execute a contract between the awardee and a third party is a separate and distinct duty. In my view, it is the separate and distinct duty of the third party to execute the contract, and not a duty of the government to authorize the third party to do so. 45 The majority opinion fails to cite any case holding that the government's duty to execute a contract between the awardee and a third party is a duty created by the Act.
